1. Acceptance of Terms

By accessing or using any website, landing page, survey, assessment, or eligibility check operated by Eagle Digital Systems LLC ("Company," "we," "us," or "our"), you ("User" or "you") agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use our services.

These Terms apply to all visitors, users, and others who access our web properties, including the Mortgage Magic platform and any associated survey or eligibility assessment tools.

2. Description of Services

Eagle Digital Systems LLC operates digital lead generation platforms, including mortgage and home equity eligibility assessments ("Assessments"). Our services connect individuals who may be interested in mortgage, refinance, home equity line of credit (HELOC), or related financial products with third-party lending and financial service companies ("Partners").

We are not a lender, mortgage broker, mortgage banker, financial advisor, or credit counselor. We do not originate, underwrite, fund, or service loans of any kind. We do not provide financial, legal, tax, or investment advice. Any information provided through our Assessments is for general informational purposes only and does not constitute an offer to lend or a commitment to provide any financial product.

Completing an Assessment does not guarantee that you will be matched with a Partner, qualify for any financial product, or receive any particular rate, term, or loan amount.

3. Eligibility

You must be at least 18 years of age and a resident of the United States to use our services. By using our services, you represent and warrant that you meet these requirements.

4. How the Assessment Works

Our Assessments ask a series of questions about your financial situation, goals, and property to help determine potential eligibility for certain financial products offered by our Partners. Upon completion of an Assessment and submission of your contact information, we may share your responses and contact information with one of our Partners so that they may contact you directly.

We do not guarantee a response from any Partner, nor do we guarantee a specific outcome from any inquiry submitted through our platform. Any follow-up, including rates, terms, approvals, or denials, is solely at the discretion of the Partner.

5. No Financial Advice

Nothing on our platform constitutes financial, mortgage, credit, investment, legal, or tax advice. All content, including estimated ranges, potential savings figures, or illustrative examples, is for informational purposes only. You should consult with a licensed financial or mortgage professional before making any financial decisions.

6. TCPA Consent and Communications

By submitting your information through any Assessment on our platform, you expressly consent to be contacted by Eagle Digital Systems LLC and/or its Partners regarding mortgage, refinance, home equity, and related financial products and services. This includes contact via:

• Telephone calls (including prerecorded or artificial voice messages)
• Automated telephone dialing systems (autodialer)
• Text/SMS messages
• Email

You may be contacted at the telephone number and email address you provided, even if those numbers are registered on a federal or state Do Not Call registry. Consent is not a condition of any purchase or service, and you may revoke consent at any time by contacting us at hello@mortgagemagic.co.

7. User Representations

By using our services, you represent and warrant that:

• All information you provide is accurate, complete, and current.
• You are using the service for your own personal, non-commercial purpose.
• You will not submit false, misleading, or fraudulent information.
• You will not use our platform to violate any applicable federal, state, or local law or regulation.
• You will not attempt to interfere with, disrupt, or gain unauthorized access to our systems or data.

You may not use our platform to:

• Submit information on behalf of another person without their consent.
• Harvest, scrape, or collect data from our platform by automated means.
• Reverse-engineer, decompile, or otherwise extract source code or data structures.

Our platform may link to or integrate with third-party services (including Partner websites, scheduling tools, or analytics providers). We are not responsible for the content, privacy practices, or terms of any third-party services. Accessing third-party links is at your own risk.

11. Disclaimers of Warranties

OUR PLATFORM AND SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE PLATFORM WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS.

12. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, EAGLE DIGITAL SYSTEMS LLC AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING OUT OF OR RELATED TO YOUR USE OF OUR SERVICES, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. OUR TOTAL LIABILITY TO YOU FOR ANY CLAIMS ARISING FROM THESE TERMS OR YOUR USE OF OUR SERVICES SHALL NOT EXCEED $100.

13. Indemnification

You agree to indemnify, defend, and hold harmless Eagle Digital Systems LLC and its affiliates, officers, directors, employees, and agents from and against any claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys' fees) arising from: (a) your use of our services; (b) your breach of these Terms; or (c) your violation of any law or the rights of any third party.

14. Governing Law and Dispute Resolution

These Terms are governed by the laws of the State of Wyoming, without regard to its conflict of law provisions. Any dispute arising under or related to these Terms shall be resolved exclusively in the state or federal courts located in Natrona County, Wyoming, and you consent to the personal jurisdiction of such courts.

15. Changes to These Terms

We reserve the right to modify these Terms at any time. Changes will be posted to this page with an updated effective date. Your continued use of our services after any modification constitutes acceptance of the revised Terms. We encourage you to review this page periodically.
